The website orthodose.com (hereafter the ‘Website’) is operated by MedLight SRL, whose seat is registered at Rue Franciscus Vandevelde 20, 1160 Brussels, Belgium, under the number 0764.817.779 (hereafter, ‘MedLight’, ‘we’ or ‘us’).
MedLight is developing Orthodose® mobile app and it’s website.
These Terms of Use (hereafter the ‘Terms of Use’) are directed at all public users of the Website (hereafter ‘the Visitor’ or ‘you’).
Article 2. THE WEBSITE’S CONTENT
The Website, including any information, graphics, aesthetic, technical, and/or other effects, is aimed at informing you of all developments linked to the Orthodose® App and/or MedLight’s products and/or services (hereafter the ‘Content’).
MedLight has the right to adapt or otherwise modify the Content at its sole discretion and without previous notice.
MedLight will use all reasonable efforts to keep the Content up to date and correct. However, not all information may be current or complete. MedLight does not guarantee the accuracy of the Content.
Any examples that are referred to in the Content are purely illustrative. We do are best to ensure that they accurately reflect MedLight products and services. However, products and services may differ in practice.
Article 3. RESTRICTIONS ON USE
The Website is made publicly and freely available to all Visitors. You agree to use the Website and the Content solely for lawful purposes. The Content may only be used for non-commercial and private purposes.
Any use of the Website is only authorized in accordance with these Terms of Use and our Privacy and Cookies Policies. We advise you to read these Policies before accessing the Website.
By accessing the Website you acknowledge having been informed of and explicitly agree to these Terms of Use as well as the Privacy and Cookies Policies. Should you disagree with these Terms of Use or Policies you are kindly requested to leave the Website.

MedLight will erase any links to third-party websites, which to MedLight’s knowledge, make illegal content available or carry out any type of illegal activity.
Article 5. INTELLECTUAL PROPERTY
The text, layout, illustrations on the Website or any other Content are protected by MedLight’s copyright, trademark, or other rights (intellectual property and other). All Content is MedLight’s exclusive property or has been validly licensed to MedLight. Thus, all Content remains MedLight’s property even once downloaded.
Unless otherwise specified, information (textual or numeric) may be used freely so long as it is correctly referenced (i.e. MedLight is mentioned as the source) and only for non-commercial and non-advertising purposes (i.e. scientific, educational, or purely private ends). However, any use of other aspects of Content, such as the images, sound or layout, is strictly prohibited without MedLight’s prior written approval.
Article 6. EXCLUSION AND LIMITATION OF LIABILITY
To the extent permitted by law, MedLight will not be held liable for any damage that may result directly or indirectly from using the Website.
The use of any information obtained from or through the Website is done at your own risk. To the extent permitted by law, MedLight declines any liability relative to decisions made on the basis of information obtained from or through the Website.
MedLight does not guarantee the Website’s effective operation and functional performance. To the extent permitted by law, MedLight declines all liability in the case of any defect or unavailability, or in the case of any other direct or indirect damage that may arise in connection to accessing or using the Website. MedLight is not liable for any damage owing to any service interruptions, technical errors, viruses or any other factors beyond MedLight’s control.

The invalidated provision will be replaced with a provision that adequately reflects the parties’ initial intention.
Article 11. NON-WAIVER
Any activity or behaviour contrary to these Terms of Use or MedLight’s failure to enforce them can never be deemed a waiver of MedLight’s rights under said Terms of Use.
Article 12. OFFICIAL LANGUAGE OF PRIVACY POLICIES
Orthodose®‘s privacy policies are written in French and apply to users of the application. While we understand that some users may prefer to read the privacy policies in other languages, it is important to note that only the French privacy policies are considered official and binding.
We understand that translations of the privacy policies into English and other languages may be helpful to English-speaking or non-English-speaking users. However, we cannot guarantee the accuracy or completeness of these translations, as they are provided for informational purposes only. In the event of any discrepancy or conflict between the French privacy policies and their translation into another language, the French version shall prevail.
Article 13. APPLICABLE LAW AND JURISDICTION
By accessing the Website you agree to these Terms of Use, and further accepts the application of Belgian law.
Any dispute arising in connection to these Terms of Use and/or the Website is the exclusive jurisdiction of the Brussels District Courts.
The law of your habitual residence may always apply, provided that MedLight pursues or directs its relevant commercial or professional activities there. It may further be possible to apply a country’s mandatory provisions, the respect for which is regarded as crucial for safeguarding its public interests.

- The information made available via the Orthodose® tools is provided solely for documentation and information purposes.
- The Orthodose® Application cannot be used as a diagnostic or therapeutic tool or replace the clinical judgement of a qualified healthcare professional.
- The attending physician is solely and entirely responsible for prescription and monitoring of prescriptions. They are responsible for adapting these to each of their patients given that the Orthodose® application does not have and cannot take account of personal, specific patient.

Article 1. INTRODUCTION
Orthodose® is an application and a website created by and for healthcare professionals. As health care professionals, we are concerned by the respect of the private life of all. Only the data useful to the functioning of the services proposed by Orthodose® are collected. The lucrative use and sale of private data of its users is not part of our practice, we do not sell personal data and do not use them for direct marketing purposes. This privacy policy describes how MedLight, the publisher of Orthodose®, collects, uses, stores, and protects the personal data of its users.

In order to exercise your rights or to inform you, it is possible to send us a written and express request, aiming at the right which you wish to exercise accompanied by a copy of both sides of your identification card to the e-mail address dpo@orthodose.com or with the postal address of the delegate with the protection of the data by adding the mention “Delegate with the protection of the data”.
If you represent a third party wishing to exercise this right, you must also provide us with a copy of both sides of your identification card and a letter signed by the person you represent authorizing you to do so.
You have the right to file a complaint with the Privacy Commission (www.privacycommission.be)
Article 3. METHODS OF DATA PROCESSING
MedLight is committed to processing the personal data of the users of the Orthodose® application in a fair and transparent manner. The processing methods comply with the provisions of the General Data Protection Regulation (GDPR) and the Belgian Privacy Act.
The processing of users’ personal data is carried out for specific purposes, such as providing the services of Orthodose® (app and website), maintaining the application and improving the quality of the services. The collected personal data is stored on secure servers, hosted in Europe, and accessible only by authorized personnel.
Article 4. WHAT PERSONAL DATA DO WE PROCESS?
4.1 – Registration data for the Orthodose® app:
- Category of personal data: E-mail address
Purpose: To register you for the Orthodose® app, to keep a record of your (re)login, to keep you informed of new developments related to our products and/or changes in the terms of use. - Legal basis: Consent;
- Data source: The data subject;
- Retention Period: Five years from the end of the subscription;
- Third parties with whom data is shared: None.
4.2 – Sensitive data (GDPR Article 9.1):
No sensitive user data is collected. It is, furthermore, reminded that, in accordance with the general terms of sale and use, the Orthodose® application does not collect any personal and specific patient data.
4.3 – Newsletter
- Category of personal data: E-mail address;
- Purpose: To keep you informed of any developments related to our products and services;
- Legal basis: Consent;
- Data source: The data subject;
- Retention Period: Until consent is withdrawn;
- Third parties with whom data is shared: ICT subcontractors specialized in sending newsletters and e-mailing.
4.4 – Contact Form
You have the possibility to contact us, whether as a user of the application, the website, or for commercial purposes. The processing of a contact form completed by a visitor to the website is based on consent and it is the responsibility of the visitor in question to determine what data is relevant to his or her request and to limit the sharing of information to what is strictly necessary for the purpose of the request. If in doubt, we recommend that you only provide your identifying information, contact information and your request. Orthodose® will take care of identifying any additional information that is necessary for the request in question.

Personal data are processed for the purpose of ensuring the execution of the rights and obligations provided for in the contract for the use of the application and its website.
Without this personal data, the conclusion and execution of the contract is impossible.
Article 6. YOUR RIGHTS
Your rights are the following:
- Right of access: you have, at any time, access to your personal data.
- Right to rectification: you can at any time rectify the personal data collected by our company.
- Right to erasure: you may at any time request that the personal data collected for the above purposes be erased under the conditions of Article 17 of the GDPR.
- Right to limitation of processing: you have the right to limit the processing of data collected under the conditions of Article 18 of the GDPR.
- Right to portability: you have the right to request that the collected personal data is transmitted, in a structured and customary format, to yourself or directly to another entity, subject to the technical possibility to do so.

- Right to withdraw your consent: where specific consent is required (Articles 6.1.a and 9.2.a), you have the right to withdraw your consent at any time without prejudice to the lawfulness of the processing based on consent carried out prior to the withdrawal of consent.
- Right to object: You have the right to object to the processing of your personal data for direct marketing purposes, including profiling.
Article 7. TRANSFER OF PERSONAL DATA TO THIRD PARTIES
We do not sell the personal data we collect to third parties. We do not disclose the personal data we collect to third parties, except as described in this Privacy Policy.
Orthodose® website uses third-party services to enhance the user experience and services offered on its application. Strictly for the purposes described above, we may share your personal data with related companies or third parties who process such data on our behalf.
Where these service providers act as our data processors, we do not authorize them to use or disclose the data in any way except as specified in this Data Protection Policy. We require such subcontractors to adequately protect the confidentiality and security of the personal data they process on our behalf.
We have carefully selected our partners based on their compliance with the GDPR and our commitments to our customers. Google’s Captcha and Analytics services have been banned from our website.
We may also disclose your personal data:
- if we are required to do so by law or by legal process;
- at the request of law enforcement authorities or government officials;
- when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss; or in connection with an investigation of actual or suspected fraudulent or illegal activity.
Article 8. PROTECTION OF PERSONAL DATA
MedLight SRL undertakes to take all appropriate technical and organizational measures to protect your data against unauthorized access and against illegal use, accidental loss, destruction, degradation, or any other unauthorized processing of your personal data. To this end, MedLight SRL has implemented the following measures in particular:
- Anti-virus software on client workstations and servers;
- Securing internal and external communications by a firewall;
- Encryption of all data on workstations and servers.
In case of violation of your personal data, MedLight SRL undertakes to inform you as soon as possible if this violation creates a high risk for your rights and freedoms.
Article 9. DURATION OF CONSERVATION OF COLLECTED PERSONAL DATA
The personal data of the users of the Orthodose® application are kept for the duration of the use of the application. After the end of the use of the application, the personal data of the users will be kept for an additional period of five years from the end of the subscription. After this period, the data will be deleted.
